Welcome to SHOPZIM. These Terms of Service ("Terms") govern your access to and use of our website www.Shopzim.in and the purchase of any products or services from us.

By accessing our Site or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms, including any additional terms and conditions and policies referenced herein. Please read these Terms carefully before accessing or using our Site.

1. Account Terms

1.1. By agreeing to these Terms, you represent that you are at least the age of majority in your state or union territory of residence (18 years in India) and are legally competent to enter into a binding contract under the Indian Contract Act, 1872.

1.2. You may be required to create an account to access certain features or make purchases. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.

1.3. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account details, including your email address and payment details, so that we can complete your transactions and contact you as needed.

1.4. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we suspect unauthorized, fraudulent, or illegal activity.

2. Pricing and Payment

2.1. All prices listed on the Site are quoted in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise.

2.2. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service without prior notice.

2.3. We accept payments through various payment methods, including credit cards, debit cards, Net Banking, Unified Payments Interface (UPI), digital wallets, and Cash on Delivery (COD) (if applicable).

2.4. Payment processing is facilitated by third-party payment gateways. By submitting your payment details, you authorize us and our payment processors to charge the designated payment method for your total order amount. We are not liable for any payment failures, delays, or unauthorized transactions processed through third-party gateways.

3. Product Descriptions and Accuracy

3.1. We make every effort to display as accurately as possible the colors, images, and specifications of our products. However, actual colors and appearances may vary depending on your device's display settings.

3.2. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion.

3.3. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

4. Order Acceptance and Cancellation

4.1. The receipt of an order confirmation email does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

4.2. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

4.3. Cancellations by Customer: You may cancel your order within 2 hours of placing it or before it has been dispatched, whichever is earlier, by contacting us at manpreet.bad31@gmail.com. Once an order has been dispatched, it cannot be canceled and must follow our Returns Policy.

4.4. Cancellations by Store: If we cancel your order after your payment has been processed, we will issue a full refund to your original payment method within 7 business days.

5. Shipping and Delivery

5.1. We deliver products across eligible pincodes in India through third-party logistics partners.

5.2. Estimated delivery times are generally within 3-7 business days after order confirmation. However, delivery times are estimates and not guaranteed. Delays may occur due to unforeseen circumstances, courier delays, weather conditions, or public holidays.

5.3. Shipping charges, if applicable, will be calculated and displayed at checkout before you complete your purchase.

5.4. Risk of loss and title for items purchased pass to you upon delivery of the items to the delivery address provided by you.

6. Returns and Refunds

6.1. Return Window: You may request a return for eligible products within 7 days days of delivery, provided the item is unused, unwashed, in its original condition, and accompanied by original packaging and tags.

6.2. Non-Returnable Items: Certain categories of products (e.g., perishable goods, personal care items, customized products, innerwear) are non-returnable due to hygiene and safety reasons.

6.3. Refund Process: Upon receiving and inspecting the returned item, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method (or via bank transfer/store credit for Cash on Delivery orders) within 5–7 business days.

6.4. For damaged, defective, or incorrect items, please contact us at manpreet.bad31@gmail.com within 48 hours of delivery with photos/videos of the issue.

7. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Site or its content:

For any unlawful purpose or to solicit others to perform or participate in any unlawful acts under Indian or international laws.
To violate any applicable central, state, or local regulations, rules, or laws.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
To transmit any worms, viruses, Trojan horses, or any code of a destructive nature.
To collect or track the personal information of others or engage in spamming, phishing, pharming, or scraping.
To upload or transmit false, misleading, defamatory, obscene, or hateful material.

A breach or violation of any of the Terms will result in an immediate termination of your access to our Services.

8. Limitation of Liability

8.1. To the maximum extent permitted by applicable Indian law, SHOPZIM, its directors, officers, employees, affiliates, agents, contractors, and service providers shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, or replacement costs arising out of or in connection with your use of the Site or any products purchased using the Service.

8.2. In no event shall our total aggregate liability to you for all claims, damages, losses, and causes of action exceed the total amount paid by you to SHOPZIM for the specific product or order giving rise to the claim.

9. Governing Law and Jurisdiction

9.1. These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019 (along with the Consumer Protection (E-Commerce) Rules, 2020).

9.2. Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity or breach thereof, shall be subject to the exclusive jurisdiction of the courts located in Gwalior, India.
